Request for Proposals: Consultant on Development and Implementation of Training Programme for Labour Inspectors on forced and child labour, Including in the Electrical and Electronics Sector Deadline: 31st May 2025, 11:59 PM (GMT+8) 1. Background and Context Fundamental principles and rights at work (“FPRW”) are the foundation of the ILO’s vision of decent work for all. The 1998 Declaration, as amended in 2022, establishes the fundamental principles and rights at work, covering freedom of association and collective bargaining, the elimination of forced labor, the abolition of child labor, the elimination of discrimination in employment, the promotion of a safe and healthy working environment, and the obligations of member states to uphold these principles While there is strong international commitment to address violations of these fundamental human rights, decent work is not yet a reality for many people in the world. A well-functioning labour inspectorate can make a vital contribution to the realisation of fundamental principles and rights at work. However, these institutions encounter particularly difficult circumstances in the execution of their mandate and responsibilities. To ensure that the fundamental principles and rights of workers are upheld, it is important that labour inspectors and other law enforcement actors implement special measures in accordance with national legislation and international law. This is especially crucial for those who are particularly susceptible to abuse and exploitation. Malaysia has ratified a total of 19 Conventions and 1 Protocol, pf which 15 Conventions remain in force. Eight (8) out of the ten (10) fundamental Conventions have been ratified, which include both Conventions on child labour and ILO Convention 29 and its Protocol on forced labour. Malaysia ratified the Labour Inspection Convention, 1947 (No. 81) on 01 Jul 1963. 1.1 ILO support to Labour Inspection in Malaysia 1.1.1. ILO Project Context Past ILO projects implemented in Malaysia developed various training guides for enforcement and labour inspection on forced labour, child labour and gender-based violence. These training guides have yet to be systematically used and applied by the Government in Malaysia. In the meantime, these include: a. A Facilitators’ Manual : Training for Malaysian inspectors on forced labour, child labour and gender-based discrimination, violence and harassment in the workplace b.Forced labour and trafficking in persons: Training manual for Malaysian law enforcers which generally target police, immigration and customs The existing training tools can be used but need to be updated to current laws and policies during the implementation of the training. 1.1.2. ADVANCE Project The project Advancing Fundamental Principles and Rights at Work on Forced Labour and Child Labour in Malaysia (ADVANCE) complements this initiative supporting labour inspection system, focusing on improved capacity of labour inspectors on forced and child labour, as well as gender-based discrimination. This contributes to the Project Outcome: By 2026, enforcement of forced and child labour laws strengthened, and victims’ rights protected. The key output under this outcome includes a training programme institutionalized for labour inspectors on forced labour, child labour and gender-based violence and harassment at the workplace institutionalized. To support the institutionalization of the training programme, the project will seek to promote DOL and/or MOHR issuance of a departmental order on institutionalizing the Labour Inspection Training on Forced Labour, Child Labour and Gender-Based Violence and Harassment at the Workplace The project will also collaborate and provide technical support to the DOL-led induction trainings for labour inspectors using the institutionalized modules. 2. Objective Generally, the training programme and its implementation will contribute to improved knowledge and capacity of labour inspectors to strengthen enforcement of forced labour, child labour and gender-based violence and harassment. Specifically, the training programme designed by the consultant is as follows ; the participants would have: a. Discussed and Assessed the current practices and procedures followed by labour inspectors on forced labour and child labour, as well as gender-based violence and harassment b.Gained, discussed and analyzed information about the role, mandate and means of action of MOHR’s labour inspectorate and MAPO enforcers when addressing interrelated issues of forced labour and trafficking. c.Learned about new strategies, tools and measures to improve the effectiveness of labour inspection, focusing on areas and sectors where violations of these principles and rights at work are commonly found. d.Identified key action points and way forward to improve labour inspection on forced labour and child labour, and GBV, including the institutionalization of training guide/curriculum and tools developed by the ILO. 3. Scope of work of the Assignment The purpose of the assignment is to develop a tailormade 3 or 4-day training package on Forced Labour and child labour and implement the package to a group of labour inspectors 4. Timeframe The assignment covering 35 workdays should be completed and spread over an estimated three-month period, tentatively beginning from June 2024, with all activities concluded by September 2024. 6. Deliverables and Payments First Payment: 35% upon submission and completion of Deliverables 1-3, with clearance of the ILO Second Payment: 25% upon submission and completion of Deliverable 4, with clearance of the ILO Third and Final Payment: 40% upon final submission of Deliverable 5, final report, together with the final versions of all outputs, with clearance of the ILO. 7. Proposal Submission ILO invites consultant/s to submit a technical and financial proposal separately to [email protected], reflecting the following subject in the emails for respective documents. “ADVANCE Consultant for LI Inspection Training-Technical proposal” and “ADVANCE Consultant for LI Inspection Training-Financial proposal” 7.1 Technical Propoosal A Technical proposal bearing the detailed methodology and approach with a work plan, proposed methodology, and timeline together with highlights of relevant qualifications and relevant experience. It should contain: a. A brief overview of Malaysia Labour Inspection context b. Proposed programme design with Clear framework, methodology and approach, c. Proposed workplan, bearing structured timeline aligned with the TOR d. Highlights of relevant experience, with CV attached as an Annex 7.2 Financial Proposal A Financial Proposal bearing the daily consultancy fee rate. The financial proposal should provide details based on the proposed (or updated) workdays in line with the proposed deliverables and workplan. 8. Profile of Required Consultant Advanced university degree in labour related studies, law, education, social sciences or other relevant field Excellent knowledge of international standards and normative framework on labour inspection, child labour, forced labour and human trafficking Strong knowledge and/or experience on labour inspection Extensive experience and expertise in developing training modules, curriculum resources; high degree of training skills Knowledge of, and experience in forced labour and child labour issues in Malaysia is highly desirable Excellent knowledge of English Very good skills in MS Word and MS Power Point
